Terms of Service
1. Acceptance of these terms
These terms are between you and BasalMind, Inc., a Delaware corporation ("BasalMind," "we," or "us"), and govern your use of basalmind.com and the games and tools we build here, including Snake. By creating an account, signing in, or submitting feedback or a suggestion, you agree to these terms. You don't need to agree to anything just to play a game -- see Section 2.
2. Who can use this, and how age works here
Playing our games is open to everyone, at any age, with no account. We design our games to be appropriate for a general audience, including children, and we never block gameplay based on age.
Creating an account, signing in, or submitting feedback works differently. Before you can do any of those things, we ask a short, honest question about your age range. We don't ask for more than we need, and we don't store your exact birthdate -- just the outcome of that question. By answering it, you're representing to us that your answer is truthful. If we later learn an answer was false, we may close the related account and delete the associated data.
Signing in with Google, GitHub, or any other provider does not, by itself, confirm your age -- it only confirms you have an account with that provider. Some sign-in options may not be available to you depending on your answer to the age question above, independent of anything the sign-in provider itself does or doesn't verify.
3. Accounts
- You're responsible for keeping your sign-in credentials secure and for anything that happens through your account.
- Your BasalTribe Alias (display name) must not impersonate anyone else, and must follow our content rules below.
- We may suspend or close an account that violates these terms, that we reasonably believe was created with false age information, or that we believe is being used abusively.
- You can delete your account and data at any time -- see Manage my privacy.
4. Feedback and suggestions you submit
This section covers anything you submit through a feedback form, survey, or suggestion box on our sites -- ratings, comments, written feedback, and game or feature suggestions. It does not cover your BasalTribe Alias or account information, which are covered by our Privacy Policy instead.
You keep ownership of what you write. We're not asking you to sign away your rights to it. What we do need is your permission to actually use it: by submitting feedback or a suggestion, you give BasalMind a non-exclusive, worldwide, royalty-free, perpetual license to read, analyze, quote, adapt, and act on it -- including building something inspired by it -- without owing you payment, credit, or further permission. "Non-exclusive" means you're still free to share the same idea anywhere else, including with someone else building something similar; we're just making sure using your feedback to improve our games is never something we have to ask you about after the fact.
Submitting a suggestion does not create any contract, partnership, compensation obligation, or duty of confidentiality between us, even if we end up building something similar to what you suggested. We receive a lot of similar ideas, and we may already be working on something like yours independently. If you want to keep an idea confidential or reserve your own rights to build it commercially, please don't submit it to us.
Our current intention: if we ever monetize something built directly from a submitted suggestion, our plan is to direct the proceeds attributable to that suggestion to a charity we select, rather than treating it as ordinary company revenue. This is a statement of our present intention, not a specific dollar-for- dollar contractual formula -- we'll publish exact mechanics (what counts as attributable proceeds, which charity, how it's calculated) if and when monetization of a specific suggestion is actually being planned.
Please don't submit anything you don't have the right to share (someone else's copyrighted work, confidential information, etc.), and please don't submit anything illegal, harassing, or that violates someone else's rights.
5. Acceptable use
When using an account, submitting feedback, or choosing a display name, don't:
- Impersonate another person or BasalMind
- Use profanity, hate speech, sexual content, or harassment anywhere on the site, including in your alias or feedback
- Attempt to circumvent rate limits or other access controls
- Interfere with the operation of the site (scraping at scale, attempting to overload our servers, probing for vulnerabilities without our permission)
- Use the site for anything illegal
We may remove content or close accounts that violate this section, without advance notice for serious violations.
6. Our content
The games, code, design, and text on this site (apart from what you submit under Section 4) belong to BasalMind or our licensors. You may play our games and use our tools for your own personal, non-commercial enjoyment. You may not copy, redistribute, or build a commercial product from our games or site content without our written permission.
7. Privacy
Our Privacy Policy explains what data we collect, why, and your rights over it, including how to request deletion. It's part of these terms by reference.
8. No warranty
We provide our games and site "as is," without warranties of any kind, to the extent the law allows us to disclaim them. We don't guarantee the site will always be available, error-free, or uninterrupted.
9. Limitation of liability
Our games and site are free to use -- to the fullest extent the law allows, BasalMind is not liable for any indirect, incidental, or consequential damages arising from your use of the site, and our total liability to you for any claim is limited to the amount (if any) you paid us in the 12 months before the claim arose. Nothing in this section limits liability that can't be limited by law, such as liability for our own gross negligence or willful misconduct.
10. Termination
You can stop using the site or delete your account at any time. We may suspend or terminate your access if you violate these terms. Sections that by their nature should survive termination -- including Section 4's license and Section 9's limitation of liability -- continue to apply after your account is closed.
11. Governing law
These terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-laws rules. Any dispute that isn't resolved informally may be brought in the state or federal courts located in South Carolina, and you consent to that jurisdiction.
12. Changes to these terms
If we make material changes, we'll update the effective date above and, where possible, notify affected users before the change takes effect. Continuing to use the site after a change takes effect means you accept the updated terms.
